Member of Legislative Assembly Constituency Development Scheme is fully funded by the State Government. The main objective of the scheme is to take up works to bridge the critical infrastructural gaps in the Assembly Constituencies. Under this scheme, each MLA proposes the works that should be executed in his constituency. The District Collector gives administrative sanction for the works. This scheme was introduced in 1997-98 vide G.O. Ms. No. 84, Planning & Development (SG-2) Department, dated 14.07.1997. The allocation per constituency has been increased progressively. Lastly, it was increased from Rs.1 crore to Rs.1.20 crore vide G.O.Ms.No.134, RD & PR (SGS.II) Department, dated 29.9.2006. 50% of the allocation (Rs.60 lakhs) is earmarked for priority works specified by Government. Out of the remaining 50%, MLAs can choose works of their choice not falling within the list of prohibited works , which contains 14 types of works.

During 2007-08, vide G.O.Ms.No.64, RD & PR (SGS - 2) Department, dt 17.5.2007, the following items of works were held as priority under the earmarked component of Rs.60 lakhs:

Earmarked Component
  1. In Rural Areas:
    1. Upgradation to/renewal of B.T.roads
    2. Laying of Cement Concrete Roads.
  2. In Urban Areas:
    1. Upgradation to/renewal of B.T,.roads
    2. Laying  of Cement Concrete Roads
    3. Provision of Concrete Pavements, with storm water drains if so required.
Out of the amount of Rs.60.00 lakhs earmarked for priority works, in rural areas, works were permitted to be taken up from among the components specified above in any ratio ( Rs.10 lakhs + 50 lakhs or Rs.20 lakhs + Rs.40 lakhs or Rs.35 lakhs + Rs.25 lakhs and so on).

Untied Funds:
Under the untied funds, that is, from the balance untied component of Rs.60 lakhs, any works not falling within the ‘prohibited works’ can be taken up under MLACDS.
Notwithstanding the prohibited works,  the following works were permitted to be taken up under the untied component of Rs.60 lakhs of MLACDS as a special case.

i)In the Village Panchayats and Town Panchayats, construction of individual/Group houses on the IAY model for SC/ST/MBC/BC beneficiaries who are below the poverty line (BPL).

ii)In the Village Panchayats and Town Panchayats, upgradation of Kutcha houses, following the model of upgradation of kutcha houses under IAY for SC/ST/MBC/BC beneficiaries who are below the poverty line.

iii)Repairs  to Group houses constructed (up to 1997) under Government Schemes in Village Panchayats and Town Panchayats subject to an allocation of not exceeding Rs.10,000/- per house.

iv)Construction of buildings, compound walls and purchase of furniture and equipments for all types of Government Hospitals, PHCs and Government Veterinary Hospitals.

v) Construction of Buildings, Compound walls and purchase of furniture and equipments for Panchayat Union/ Government Schools and Government colleges.

vi) Construction of buildings for Public Distribution Shops, Direct Purchase Centres, Milk Producers’ Co-operative Societies and Bulk Chilling Centres.

vii) In Urban areas, repairs to houses constructed (up to 1997) by Tamil Nadu Slum Clearance Board / Tamil Nadu Housing Board/ TAHDCO with the recommendation of concerned MLA subject to a ceiling of Rs.10,000/- per house.

For the year 2008-09, out of the tied component of Rs.60 lakhs, Rs.10 lakhs is proposed to be earmarked for taking up Anganwadi Buildings and the Kitchen sheds in rural/urban areas and Rs.50 lakhs will be earmarked for B.T. roads, CC roads and Burial/Cremation grounds in rural and urban areas and CC pavements with storm water drainage as per the need in urban areas.

PROHIBITED WORKS:

The following are the ‘prohibited works’ under MLACDS:

      1. Office and residential buildings belonging to Central and State Governments, their Departments, Government Agencies/Organisations and Public Sector Undertakings.

      2. Office and residential buildings, and other works belonging to private, co-operative and commercial organizations.

      3. All works involving commercial establishments/units.

      4. All maintenance, repair and renovation works of any type.

      5. All renovation and repair works except heritage and   archeological monuments and buildings with specific permission available from the Archeological  Survey of India and also Department of Archaeology of Tamil Nadu.

      6. Grants and loans, contribution to any Central and State/UT Relief Funds

      7. Assets to be named after any person.

      8. Purchase  of  all movable items except vehicles, earth movers and equipments meant for hospital, educational. sports, drinking water and sanitation purposes belonging to State and Local Self-Governments. (This will be subject to 10% of the capital cost of the work for which such items are proposed).

      9.  Acquisition of land or any compensation for land acquired.

      10. Reimbursement of any type of completed or partly completed works or items.

      11. Assets for individual/family benefits.

      12. All revenue and recurring expenditure.

      13. Works within the places of religious worship and on land belonging to or owned by religious faiths /groups.

      14. Desilting of ponds, ooranies, rivers, tanks, canals, channels, etc.

The total allocation for MLACDS for 2008-09 is Rs.282 crores.
